Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

Cube Pop is rated 4+ in the App Store and is appropriate for all ages. To make in-app purchases or manage a subscription, you must be old enough to enter into a binding contract in your jurisdiction, or have a parent or legal guardian who has authorized the purchase through Apple's Family Sharing or Ask to Buy features.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use.

This license is subject to the Apple Standard EULA (the "Licensed Application End User License Agreement"), available at apple.com/legal/internet-services/itunes/dev/stdeula, which is incorporated by reference. To the extent these Terms and the Apple Standard EULA conflict, the terms more favorable to you control.

You may not:

• Copy, modify, adapt, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law that cannot be waived by contract
• Tamper with, bypass, or circumvent the in-app purchase mechanism, paid feature gates, or any security measures
• Rent, lease, lend, sell, redistribute, sublicense, or commercially exploit the App
• Remove or alter any proprietary notices, trademarks, or labels

4. Subscriptions and Lifetime Purchase

Cube Pop offers two auto-renewing subscriptions and one non-recurring purchase. Premium grants access to all 15 levels, all visual themes (Crystal, Candy, Neon), in-game power-ups (additional tray refreshes and a revive on game over), and ad-free play. (Cube Pop does not show ads in any case — Premium is purely for content access and power-ups.)

Local pricing may differ; the price displayed in the App at the time of purchase is the binding price. Apple converts USD prices to your local currency using Apple's price tier conversion.

Apple-Mandated Subscription Terms

Free Trial

The Weekly plan offers a 3-day free trial for first-time subscribers. Payment is collected after the trial ends unless you cancel at least 24 hours before the trial ends. Cancelling during the trial preserves access for the remaining trial days and prevents the first paid charge.

Lifetime Purchase

The Lifetime unlock is a one-time, non-recurring purchase. It is tied to your Apple ID and can be restored on any device signed in with the same Apple ID using the in-app Restore Purchases button.

Price Changes

We may change prices from time to time. Changes will not affect any subscription you have already purchased until renewal, and for subscriptions Apple will notify you of material price increases as required.

5. Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple via reportaproblem.apple.com. We do not have the ability to issue App Store refunds directly.

6. Acceptable Use

You agree not to use the App to:

• Violate any law or regulation
• Tamper with, attack, or interfere with the App, our servers, or our payment provider
• Attempt to bypass paid feature gates or to obtain Premium features without payment
• Misrepresent your identity to Apple or to us in connection with a purchase or refund
• Use the App in any manner that could damage, disable, overburden, or impair any system

7. Intellectual Property

The App and all of its content — including source code, level designs, artwork, illustrations, animations, sounds, fonts, logos, and trademarks — are owned by us or our licensors and protected by copyright, trademark, and other laws. Nothing in these Terms grants you any rights to our trademarks, trade dress, or branding.

The Cube Pop name, logo, and visual identity are our trademarks. You may not use them without our prior written permission.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• DEFECTS WILL BE CORRECTED
• THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• ANY PARTICULAR LEVEL IS SOLVABLE BY YOU IN ANY PARTICULAR NUMBER OF MOVES

Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusion may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US (THROUGH APPLE) IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of certain damages. Nothing in these Terms limits or excludes our liability for fraud, gross negligence, or any other liability that cannot be limited or excluded by law.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person
• Your violation of any applicable law

11. Apple-Specific Terms

You and we acknowledge that:

• These Terms are between you and us, not Apple. Apple has no responsibility for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• We, not Apple, are responsible for addressing any product-liability or intellectual-property claims relating to the App.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Termination

These Terms remain in effect until terminated. We may suspend or terminate your access to the App if you violate these Terms. Upon termination, the license granted in Section 3 ends and you must stop using and uninstall the App.

You may stop using the App at any time by uninstalling it. Sections 7, 8, 9, 10, 11, 13 survive termination.

13. Governing Law

These Terms are governed by and construed under the laws of the Republic of Türkiye, without regard to conflict-of-law principles. To the extent applicable consumer-protection laws in your country grant you additional rights, those rights are not affected.

If you reside in the European Union or the United Kingdom, you may also bring claims in the courts of your country of residence, and you retain the protections of mandatory local consumer law.

14. Changes to These Terms

We may update these Terms at any time. When we do, we will update the "Last updated" date and, for material changes, provide notice within the App. Continued use of the App after changes constitutes acceptance.

15. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.
